I get the same calls from several different area codes, all day long, every day. Then after my continual ignoring the calls I don't recognize, they actually called my son's phone. They weren't even given his cel number. They apparently just found someone near to where I live with my last name, which is an uncommon name, and then called him. It's apparently part of their business practices to shake people down for money. My guess is that they pay people little money to sit in cubicles and make these unrelenting calls. Lamo!!!

Just started receiving these calls from this number (Santander.) Got me as the wrong person w the same name. Never even purchased a car w a loan in my life. It seems dept collectors use any way to find and contact who ever they're looking for. She seemed nice on the phone, apologetic and patient. I'm sure she knows their company can get in serious trouble for harassing the wrong person. Plus it shows how terrible their collection agency is when it comes to doing real business. She told me she will have my number sent to the manager who controls the list of numbers. From there they would have my number remove within 24/48 hrs. Thank goodness I don't do business w these people. The caller seemed really rude on the phone leaving the voicemail. Jerks!! To all of you who have to do business with these people, I hope the best for you all! I will keep you posted if they don't remove my number.

just purchased car  1st payment due September16.  They have been calling me since Aug. 8th.  I spoke with them then just validating loan they said, but I keep getting calls 3 to 4 times a day no message an from 2 different numbers??  I am being harassed before payment even due.

I agree with all the responses. My car loan was through Citibank. The first time I had to call customer service I was surprised to get a damn Indiana on the phone. I asked the *(&D(*& if he was in India. He paused and they said yes. I demanded to talk to an American and he said there were none!The only American line I guess was finance. I was enraged because I am so sick of our jobs going to Indian. Next time I called I demanded to talk to the finance people. The agent said there was NO CUSTOMER SERVICE in the states. I was sooooo mad. I would like to have a company with CS in the United States!!Then I get a letter stating that Sanlander will be taking over my car loan. At least I had heard of Citibank. Then Sanlander?, it is some sort of hispanic company or something. And I still get Indians when I call in. I called in once to make sure I would not be charged extra for sending my payment through the bank. Cause as you all know their terms for payment were not clear. If there is anything I can't stand is "pay to pay"!! I WISH I HAD ANOTHER PROVIDER!

I know this is late, but you can send a limited 'cease and desist' saying that all calls are 'inconvenient' and they are to only contact you through by US mail.  Send it CMRRR and keep a detailed log of any phone calls after you get the card back.  You can sue them if they keep calling.

the DNC registry only applies to telemarketers.  If money is owed to a company, they are allowed to contact the debtors.  I know this, as I am always getting calls from my own collection agencies.  I dont LIKE it, but I researched everything to know where I stand with my rights, and thats just how it is.  The government is not going to ban companies from trying to collect on debts.  I try to pay on mine, even if its just a few dollars, and i start getting on track, then WHAM!  medical emergency or WHAM!  car needs costly repairs.  Santander seems to be totally devoid of humans in their workforce though.  After I tried to get a deferment, after paying early every month for 2 years, I was told that I was not eligible for deferment because I was not behind by 3 or 4 months.  I said, fine, I will not be paying until the 27th late day of my payment from now on.  that was a year and a half ago.  They call work and home.  i hang up on all their numbers, of which there are many.  They get their money on my terms.  they deal with me on my terms.  i owe some late fees, but its worth it to not deal with the morons at all.

Goodness people!  If you're going to give out legal advice, please do some research and make sure it's correct before posting!The National Do Not Call list does not apply to bill collectors.  It applies only to solicitation calls.  You cannot do a blanket "opt out" for collection calls.  You can request, in writing, that the collector only correspond with you in writing.  But, the company can require that you submit this request in writing and does not have to comply with verbal requests for no calls.  After all, you did borrow money for the car you purchased.  They have the right to call you to ask for payment until you make a formal request to not be contacted by phone.  This does not fall under the umbrella of "harassment".  If you want to get very technical, in legal terms, "harassment" can only be considered a criminal issue and cannot be the grounds for a civil lawsuit.  I'm guessing you learned that when you attempted to file your lawsuit against them.Additionally, the Fair Debt Collection Practices law that I think you're attempting to cite only applies to 3rd party debt collectors.  Since the company calling you is essentially "the bank", they are 1st party and therefore do not have to follow this law.  Lucky for most debtors, they do follow the law voluntarily because it is good business practice.  So, legally, they can call you every 10 minutes if they want to.  The only way to make it stop is to pay your bills on time or to submit a written request that they cease telephone communication.Finally, the Attorney General's office has no interest in this company of their business practices.  It is actaully the Federal Trade Commission (FTC) that governs this type of activity.  If you want to file a complaint with anyone, I'd suggest them.  But, be aware that they don't respond individually to complaints.  They simply track trends and action only the largest offenders.Just call this company and work out payment arrangements.  It will save everyone involved from a great deal of frustration.

We have a new phone number that apparently was previously held by a Santander customer.  Even after notifying them that we are not the person(s) they are trying to reach - and that they can verify this with the phone company since our number is listed - they continue to harrass us with calls at all hours of the day and night.  So, on their website I found:We are registered under the State of Texas and are subject to regulatory oversight by the Office of Consumer Credit Commissioner. If you wish to file a complaint against Santander Consumer USA Inc., you should contact the Office of Consumer Credit Commissioner at 2601 North Lamar Boulevard, Austin, TX 78705-4207 or by telephone at 800.538.1579Thought some here might be able to benefit by the information.

Not true attydallas!  Collectors all use predictive dialers.  I used to work for multiple collection agencies (3rd party) and banks (1st party).  Both use predictive dialers.  They are programmed to pass the call to a collection agent when the call is answered at the other end.  This is why you ALWAYS have to say hello twice.  The first time you're saying "hello" to the computer, the second time the agent hears you.Additionally, 1st party collection departments don't have to be registered and licensed.  These calls are coming from the holder of the note.  They don't have to have any special licensing to call and request that payments are made on time for loans they granted.  That only applies to 3rd party collection agencies who are paid by the holder of the note for collection services.Maybe it's time to go back to law school?

Well, several problems here .. First, debt collecotrs, unlike telemarketers, do NOT use "predictive dialers", since each debt is individualized (e.g. different amounts, sometimes owed to different creditors).  They have to be able to respond if a person picks up.  Hence that is why devices like the Telezapper do not work with creditor calls, unfortunately .. As to the National Do Not Call Registry (and the TX Registry), there are exceptions for calls from creditors, collection agencies, or anyone with whom the listed # has had a previous biz relationshiip.  So putting your name on the list won't stop collection calls.  Third, although Greg Abbott is doing a good job in office, his office will usually seek injunctive relief (i.e. get a court order requiring that a co. stop abusive practices) under the collection and DTPA laws only if enough consumers complain about a particular harrassive collection co. to his office to make it worth his agency's time.   One thing to do if you are in TX is to check with the Att General's office's website to make sure the collection agency is licensed and bonded to do collection work.  Otherwise, they are operating in violation of the law (you'd be surprised how many aren't licensed).  That fact makes it more likely the AG will take action against that company, plus it's good ammo to use against them next time the collection agency calls you!

This is a business that you have a previous relationship with.  they have the right to call about a past due bill.  The issue here is the # of calls they make after you have already spoken with them.  DONOTCALL LAWS do not cover that issue at all .THESE NUMEROUS  HARRASSING CALLS FROM ORIGINAL CREDITORS GET REPORTED TO THE FTC.. When Anybody call that you do not want to talk too, if it is your cell, check the phone number out and type do not answer. If they call from another number, type that in too. Do not answer. They WILL stop calling. It works for me.calling

I beg to differ DHnKC, these are not all sub prime loans.  My husband and I have a loan on our RV which was with GEMB Lending and not sub prime.  We never got calls from them unless we got more than 15 days late, which was rare.  On the other hand, calls from Santander start the day after the actual due date i.e. if the payment is due the 10th, we get calls on the 11th, several a day from varying numbers.  They have been nice enough when we have had them on the phone but the calls do start the day after the payment is due.  By trade I am a mortgage fraud investigator for a large mortgage servicer so I am well versed in FDCPA Rules.  People need to educate themselves and take appropriate action when debt collectors break the rules.

If you make your payment through bill pay at your bank or credit union you need only make your regular payment.  I originally had my loan with Sovereign Bank in Pa. and suddenly it was changed to Santander Consumer USA in Dallas.  Santander is actually owned by an European company, another case where the USA gets the shaft.

Not all subprime.  They apparently bought all of the Citifinancial Auto loans.  Ours was not subprime and not late.  Paid every month 4 days early by bill pay electronically.  They just took over our loan this week and since the payment went to Citifinancial they didn't get it by the due day from Citi and they called us.  They were very polite though.

These are sub-prime - high risk loans.  Your payment is due on the due date - there might be a 10 or 15 day period before they assess a late charge but because of the risk involved in these loans, collection begins the first day your are late.

I am going to file a lawsuit for 'Harrassment' against Drive Financial & Santander Corp... I get 5 harassment calls a day and they even call me once or twice after 9 p.m. at night... The problem is that you and I don't do anything about it... No they will not ..... I tried that and even made the payment earlier than I had arranged to and I still get phone calls. My payments are caught up and paid earlier than they are supposed to be yet I get at least 3 calls a day. 1st time  no one answers, 2nd time I let the answering machine pick it up and I get the "Hello this is Santandar calling regarding personal business, and the 3 rd time is another hang up phone call.  I called them back and when I talked to the person on the other end of the line she couldnt explain why they were calling. So I told her if it happened again I would report it to my AG and still they called again. SO I called the AG in Missouri  and reported it.

This is not true.  The FDCPA states that collectors can make 1 contact per day, per phone number with you.  A contact is defined as leaving a message or talking to a person.  This is why they don't leave messages in the morning.  If they did, they wouldn't be allowed to call back until the next day.  If you simply answer the phone and tell them when you intend to pay, they will stop calling for the day.  If you keep ignoring them, they will keep calling.

Actually it's not more than ONE call per day allowed to a #, whether it's an "attempt" or actual conversation.  The onlly exception is if you talk to them and give them permission to call you back later that day.

You should get your facts straight before making comments like "People Its against the Law for Consumer USA or Drive Financial to be calling you more than 3 times a week. 4 5 times a day".   The fact is that you cannot call and SPEAK or LEAVE A MESSAGE  to/for someone more than 1X per day but you can attempt to reach them up to 8X per day.  The reason that collectors do not leave messages is because they would not be able to try and contact you again that day.  Usually when a message is finally left it's in the late afternoon or evening.  You can receive collection calls from 8AM - 9PM in your time zone.The sure fire way of eliminating collection calls is to pay your bills on time - plain and simple!

FDCPA actually states that collectors can call from 8 AM to 9 PM.  Just wanted to clarify so that people cite the law correctly.  Nothing makes collectors strike back harder than when debtors try to cite the law incorrectly.

Next time they call cite the Fair Debt Collection Practices Act to them. It states that they can't call you before 8am or after 8pm. It also states that if you notify them in writing that they can't call you at your place of employment, they have to honor it. Make sure you send the letter certified return receipt requested so you have proof they received it. Google Fair Debt Collection Practices Act. It will tell you what is legal and what is not. When you throw that out to a collector, they back off real quick.

Santander is a subsidiary company. At least they usually leave a message. The folks there have been polite when I've spoken with them. But Drive- another story. They call late, not late, paid, not paid. Drives me nuts. Somehow got my teenager's cell # and started calling him. What the heck is that about? I've been late twice and called when I knew I was going to be late to make arrangements. Still got phone calls sometimes as many as 9 on the house phone and 4-5 on my cell, plus several calls at work! Utterly ridiculous.

I make partial payments and they accept them. I am also 1 month behind because of hardship and they refused a deferment. They will tell you that they don't accept them, but say if your payment is $400 a month and you pay $450, they will accept it. I do mine through my online banking and it's electronically transferred to their accounts so they HAVE to credit me that money.

Just send the partial payment in-watch they will take it. Also, do not defer payments with this company. My ex did and ended up owing over $6,000.00 in interest and penalties. He causes me to be 2 weeks late each month, due to paying my alimony late, but I pay the late fee and and other fees. They don't like it and tell me I only owe the principal, but I pay it all so I don't end up with a big bill at the end or if I trade the car in before I finish paying it off.

If they told you they won't take partial payments they are lying to you! They will take whatever money you send them. I pay just slightly over half a monthly payment every 2 weeks and they take it. If you can afford to pay half your payment every 2 weeks you'll make 13 monthly payments in 12 months. This will get you current. I also logged on to my account and changed my work and cell phone numbers to numbers that don't exist. This ended the annoying calls. Lastly, do what I intend to do. Do a total money makeover. Commit to a life with no debt. Pay off this(and all) debt as quick as possible. Then start making a monthly car payment to yourself in an interest bearing account. Save up and buy your next car with cash. Stop dealing with these leeches!!

They did. They call incessantly, and when I explained that I had missed one payment, due to a documented hardship, and was requesting a deferment of that payment, they said I wasn't far enough behind to be eligible. I'm constantly one month behind because I can't afford two payments in one month, and they said they wouldn't take partial payments. Eventually, when I insisted, the rep claimed to apply for a deferment, but if there was an application made, it was declined. I have written to them and asked for help, and they literally ignored my letter.I am about ready to write and tell them I want to do business in writing only--but I'm afraid that will lead them to repossess in retaliation, even though I'm only a month behind (and wouldn't be that if they'd work with me). Any thoughts, anyone?Btw, they have a 214 number which still says it's Drive--but Santander is the new name. You can get calls that say they're from both companies, apparently. But Drive is now Santander. I think they had another name at one, too--something about Road or something like that. They never call our references, but they call us 3-5 times a day, on home and cell numbers.

They also just recently took over Citi Financial Auto loans.  They have done nothing but harrass myself and my wife and I have advised them that they need to contact Citi to find out why the pmts are not reflecting properly.  The first call from an 888 # then the call from a 219 #, then the call from an Unknown #, all w/ in minutes of each other.  Wow, let me answer the call from the local # since i didn't answer for the toll free one.  or better yet let me answer an unknown #....How dumb must they think I am????  apparently not as dumb as them trying this method to contact me......i should just give the truck back seeing as how i am upside down in it anyway!!!

Took over from HSBC and I have a 10 day grace on my loan whether they like it or not. Santander really needs to be turned into the Atty. General for harassment as defined... Can legally only call once every so many days. I never answer when they call because even if you talk to one of their a**les, they'll still call every day. I don't know how another human caN WORK FOR SUCH AN OUTFIT. If anyone from santander is reading this... go f**k yourself. Actually, Santander is also a creditor. We refinanced our auto loan with them a few years ago. We have never had a problem with them at all. When I was laid off this year after an extended medical leave, all we had to do was call them, explain the situation and they extended our payment. When the first extension ran out, we called again asking for an extension. We were advised to wait until a specific date and call back to request the extension. Although we did start getting a few calls from their collections department, we were able to go ahead and extend the payments out once more. Clearly, this is not the best situation, but it is what we have been dealing with. They have been very nice to us and hopefully, things will be better in 2 months when this extension expires. We only have a few more months left on our loan so we want to pay it off as soon as possible.

One thing you dont seem to realize is that Santander is NOT an original creditor.  They are indeed Debt Collectors.  They buy out loans from the original lenders, they however do now make any new loans.  They are a rip off company and dont care how many Cease and Desists letters you send them.  They are not in USA and dont care about any of US laws.

The law most of you are quoting regarding Debt Collectors, does not apply to Creditors such as Credit cards or Car Loans.  It applies to Debt Collectors only, such as Collection Agencies etc.FTC.gov - fair debt collections practices act    FTC.gov for Credit Card banks is Fair Credit Billing ActHowever the Federal Communications, does have a similar law regarding phone calls at work.  Go to FCC.gov, and download the Complaint form,Also before you do file a complaint with FCC.gov, they will also require you send a Written notice, to Stop Calls, at work, or on certain times / days.  It's always best, to mail letter Certified Mail, so you have a receipt of when you mail and letter, and when it was received and by whom.As to Cease and Desist, again this only applies to Debt Collectors, not Original Creditors, such as on Car loans / Mortgages / Credit Cards, those are different laws entirely.  You can find more information on those at ftc.gov also.  I would personally never send an Original Creditor like this Santander, or a Credit Card bank a Cease and Desist Letter.  Santander will simply repo your car.  Santander is one of the worse Car loan finance companies, for car repos.  And when I talk to Santander, b/c of the reputation on line, I always record all my calls.  During one of these calls, I started to be told a different story, than was given by another employee - I advised that I recorded the call with the other employee, and I'm doing the same with them (my state only requires, 1 party be aware call is being recorded - so check your state's rules first), and Santander hung up on me!!!I am not an Attorney, but I am knowledgable in Consumer Protection Laws, fighting 3 lawsuits against us without an Attorney, and helping others, such as family members and friends only.  I am not giving legal advice, just educating on what I have learned, and what I do myself,  when I get calls when I shouldn't or at inconvenient times.  .

Did you know that by law once you tell them not to call your job, they have to stop or you can report them to the attorney general's office?  google debt collecting and read the law that protects consumer's.  You can also send them a Cease and Desist letter (google it for template) and they are required by law to stop all phone calls. If a bill collector calls you at work, write a certified letter to them stating you are not aloud to receive personal calls. If they call after they have received your letter (don't forget to get the return receipt requested form, which states when they received it and who signed for it and include your account number!!), you then have legal recourse against them. This falls under federal regulations.You must put it in writing.I also have an account that they purchased. I do not answer them. Also, if you go online you can find out what the statues of limitations for each type of loans for your state has. For example, in Maryland, if you owe a debt and for what ever reasons (like hardship,layoff,divorce,etc.), and you have NO contact with them for 3 years, you no longer owe the debt (this is for credit cards). Each type of loans carry different time lines, and each state is different, but there is a complete list for each state and each type of loan-just google it.

Santander Consumer are freaking rude!!! I have a car loan on them and my due date is not until every 8th of the month. Even if it's still 4 days before my due date they won't stop calling and they are always calling me at work too. I got in trouble for personal phone calls one day. I told them I'm not allowed to take personal phone calls at work but they would not stop.I thought every loan company they atleast give you grace period. They have now also bought out all of the HSBC Auto loans.   I'm ontime and my first payment with them is not due yet.  They are war-dialing my work and mobile phones... no one there.   Will probably be looking to see what I can do legally if this keeps up!

Here's some information for you.The vast majority of companies calling you, regardless of the company's size, utilize a computerized system to make their outbound sales and collection (recovery) calls. These systems make more efficient use of tha call center employee's time. The computer makes the outbound call and waits for the line to connect. When you answer the phone, the computer will register the connection and will then transfer the call to a representative who will handle the call. The process works fine, as long as there are enough representatives working to handle the number of calls being answered. If, after a default period of time, the computer cannot connect to an available representative the call will be disconnected. The computer will register the call as a non-connected call as a representative did not speak with you. Your number is then returned to the call queue to be called again when your number cycles to the top again to be called.Their agents are not calling you and listening to you repeatedly say hello.*Rule of thumb. --> If no one responds after you have said hello twice, just hang up and go on with your day., Sadly, they will call again since they have not actually made contact with you. Complaining to a rep once you do get to speak with a person is useless as they just speak to people when the call connects to them. Typically, they are not even able to make outbound calls from their station. Some manager or supervisor is overseeing the call load as directed by some manager who isn't even at the facility.

Those that have researched phone #'s  and reading the posts are learning from others experiences. When you get phone calls from  a phone # you don't know you should be researching them so that you don't get caught  in fraudulant schemes.  I also listened to a new report where people had been scammed and they said to always research the phone # and/or the company they CLAIM to be. Also check your state laws for harrament laws by bill colletors and file an online complaint to the FTC and the BBB.

Santander Consumer is an Auto Financial Company that has been buying up other Auto Finance Companies.  They just bought out 2/3 of CitiFinancial and so, have my loan.  They have a mix history os being very good working with their customers and also a very bad reputation for being a hard a**.  So far my relationship has been good with them, but going to pay my car off as fast as I can.   I don't want to do business with them any longer then needed. I agree completely. 50%+ of the times that I answer for them, they either hang up immediately or wait a minute to hang up. Probably lazy reps who need to meet a call quota without actually having to do anything. The rep that usually calls also hangs up on me when I try to tell her not to call at certain times. Her way of not getting that message, I suppose.

These people from Drive Financial call if you are even 1 day late with your payment and it really gets ridiculous I have small children who sleep in the morning and they call first thing 8am.The last time they called the woman said" I have no idea why we are calling you, you have only had 1 payment late and it was by a day" Needless to say I ended the call. Sorry Cliff, if you are willing to chance having your identity stolen, so be it but as for me I don't take chances.  As soon as someone wants my personal information by phone, I get suspicious and when teither or both their name and phone number is missing, I have nothing to say to them.  If RBC wants to offer a service to me, fine but do it from your own offices and their own phone number.  By the way, if the local branch and the RCMP say its probably a scam, I'll take their word over yours.  If more people took the initiative to call the RCMP when they suspected a scam, less people would get ripped off.

This is NOT a scam. Why do people always think that telemarketing calls are scams. Like most major corporations, RBC contracts some of their customer service business to call centers. What's wrong with that? In this case, if you have a RBC credit card, all they are trying to do is sell you credit card insurance, If you don't want it, just say no and hang up. No need to call in the RCMP! If everyone reported what they believe to be scam calls, no one would be able to call the RCMP. And if you've had any dealings with a company, even inquired about their product in the previous 18 months, the company (or their designate) IS allowed to contact you and is exempt from the National Do Not Call List regulations in Canada.
