It's the American Red Cross looking for blood donations.  They called me today at 12:00 p.m.  I used to be pretty good about giving blood & they would start calling me incessantly when it came about time for me to be able to donate again.  Last summer, I answered the phone when they called and told them that I was training for a marathon and would not be able to give blood until January 2013.  The woman I spoke with thanked me for letting her know and put me on some kind of list.  They did not call me again until today.  So maybe if you answer the phone and tell them that you can't donate, or that you're scheduled to donate somewhere already, they will leave you alone.  Just a thought.

Yes, they are legit. I just got a call on my cell which i did not recognize so i did not answer. came here to see if it was spam. I got Applebee windows last year and they are awesome. Top notch company and top notch windows. I am in construction and their presentation blew me away. It's too bad if their phone campaign is annoying and turning people off but I personally highly recommend them.

I (stupidly) signed up for a drawing at BJ's Wholesale to win $3,000.00 in home improvements and got on their (Applebee System's) calling list.  I started getting repeated calls from them on my cell phone.  I called them back and politely requested to be removed from their calling list.  The lady was very friendly and removed me right away.  She didn't even try to sell me anything, just thanked me for calling and told me that she'd taken care of it.

Reverse phone lookup resolves to Applebee Systems.... a home improvement and remodeling company out of MD.A couple weeks ago while out shopping, my girlfriend apparently signed up for one of those promo scams where they entice you to register to  "win free replacement windows for your home". (We in the middle of renovating a 110 year old farmhouse, so she though it might be worth the chance. Well now they call her cell phone 3 to 5 times/day but never leave a message.

This Jayshree has been calling now for months just about everyday and sometimes 4 or 5 times a day. Today is Sunday morning and this is the first time they have called on a Sunday. It is a recording that says "hello" I learned on another site that after the hello a recorded message comes on about a credit card, well I never get more than the "hello!" This is ridiculous and I think I am going to change my phone number and I hope they don't get that! I have been woken up by these jerks. They call at 8;30pm sometimes and the phone wakes me up! I have complained to the Do not call registry a couple of times already.I am going to find out if the governor can do something because this has to stop! If you try to call the number it is busy so you cannot even talk to a human being at all!

PS.Another useful tactic I found was to make all friends and relatives have a musical ring tone, and all others will have a regular ring, so if I am busy and it's not a musical tune --I don't answer. I saved their number, so when they call my caller ID says "telemarketer", and do not answer. I also saved other numbers under No, Noo, Nooo, and Not,etc. I am not participating. If I get no number, I don't answer either. I can't seem to stop them from calling, but they have to have a new number for me to answer, and everytime I will save their new number. I am glad I read your post and I now know that the "hello" is a recording because like you said I get the "hello", but after that dead silence and no recording has ever come on. They stopped for a while and today Jayshree started again. I have also tried everything and they have gotten through the loopholes for the do not call registry because I have reported them and according to them they can call. I don't see how that is possible, why bother being on the do not call registry? It is ridiculous. My husband works third shift and I work first and we both get woken up. If I happen to be home when the phone rings I just click it right after I see the name Jayshree so I don't even have to hear it ring or have the answering machine come on and when I do this they dont call back afterwards, usually not until the next day anyways. This Jayshree is truly a a***ole! Jayshree can shove their credit card up their a**! I will just shut my phone off if I have to and only use it to make out going calls!!! It is truly sad that I might have to do that and that nothing can be done about this !

Aha this is  not correct it is not always a recording today ay 4:30 pm est i recieved this call and was informed that I had won a sweepsstakes and that i had 1500.00 gift card waiting if i provide them my information and he informed me that his name was Anadale I asked him to get to the part where they wanted my credit card information so i could politly tell them to cram it and he got angry and informed me that my credit card was not needed, then i said excuse me how dare i ask for the credit card scam please give the checking account scam cause i just feel like being ripped off today then he informed mre that he was not asking for money..... so i told him his scams no matter what he was looking for would not work, because i do internet security and that i was looking at the thousands of people who were pissed off at this guy when i asked him to remove me from his calling list he told me to screw myself and then hung up. I am looking into hireing someone to trace this call to put an end to it.

If you look in the do not call.gov web site you will see that even if yournot on the do not call list that you can still tell them not to call again.In addition even if you have had business with the company or applied forcredit they are still not to call you after your request to be placed on the company's do not call list...I'm waiting for someone to come up with an actual adress so I can send the certified letter...if they continueto call after that then I can sue them in small claims court, the beautifulthing about that is they will have to send someone to court or lose the case. however even if I win it will be hard to enforce but, may cause someone a headache....

i had been having the same problem. the bad thing about the do not call list is that it cant stop all telemarketers. have you applied for credit or insurance or ANYTHING else lately? if you have then sadly its really not illegal. but the easiest way to stop it is just to listen and press 9 when it asks if you want to be removed from the list. an indian womans voice will play asking if youre sure. press 1 and the calls will stop

That is 100% completely untrue.  Very few cell phones come with features to block telephone numbers.  Check the Internet and you'll see.  In most cases, the best advice you get offered is to assign the unwanted number a silent ringtone.  Well, that's fine, if you can do that; but T-Mobile Sidekicks don't even have that option, so best bet is to try to find and download a song that has lyrics like "I'm a Loser, Baby..." by Beck so you can get a cheap laugh whenever the a$$hole calls.

Hi everyone!  I get the same call night and day!  BUT.....  I think I have finally beat them.I called cox who is my provider, there is a feature on your phone that will block unwanted telephone numbers from reaching you.  It will not even ring at your home, they will get a message saying that you are not available.TRY THIS:From a dial tone on your phone dial *60then follow the prompts.  It will ask you to enter the # to block.  I have Jayshree and the other number they use is ccr inc.......216 896 1143, also rgs 510 373 3837.  PLEASE try this, if you cannot get it to work, call your phone company.  They will tel you how to block them from getting through to you, GOOD LUCK!!!!!!!Shannon

I've read every post about this caller. The voice that says "hello" is just a recording. It is no use trying to talk to him or yell at him. No real human is on the line. If you say anything, your voice (sometimes) activates the recorded sales pitch about the credit card they are trying to offer you. Half of the time the sales pitch recording doesn't even get activated and it seems like someone is calling just to say hello and stays on the line in silence.If you do hear the sales pitch recording, you will never be able to talk to a live human being. They ask for your personal identity numbers. If you decide to apply for their credit card (thinking you will be able to get their phone number or address) you will be charged $139.00.This company has figured out how to use loopholes and automation to bypass the 'do not call registery'.There is no logic to the pattern of calls. You might think some live human is just calling to bother you. Or you will wonder why the caller is silent. Or you will wonder why they keep calling you back. You are just a potential buyer who is being contacted by an automated sales system. They will keep calling you until you sign up for their pre-paid credit card.They are bunko, con-artists who will keep bothering you forever.The police won't be able to help you. Your cell phone service will say they don't have the abilty to block the number. The Do Not Call Registery will not work against them. They have figured out how to bypass the system completely. You will go berserk from all these same calls coming from this number. Your phone provider will just tell you to change your phone number, and you will have to spend all your time having to contact friends and family about your new number. You will also have to have your checks re-printed by your bank. You will have to buy new business cards and stationary to list your new phone number. Eventually, this company will start calling your new phone number - because they buy phone numbers from someplace that you apparently do business with. They will eventually be calling you again and all your effort at getting a new number will have been wasted.There is nothing that can be done about this caller. If you sleep in the daytime (like I have to) it will be hard to focus your eyes everytime you get woken up. Still, this is what you will have to do. From now on, you will have to check every incoming phone number to see if it is someone you actually know or if it is this telemarketer.You might have to see your doctor and get some traqulizers to deal with the frustration. You might need to go to Radio Shack and buy a (non-phone company)walkie-talkie with a 10 mile signal and give them to each member of your immediate family. You might have to give up cell phones altogether and start using public pay-phones, if you can find them anywhere. Be careful using outdoor payphones though, because low-life, crackheads will hit you up for money.Being that the 'billion dollar cell-phone companies' say they don't have the technology to block these calls their is not much you can do.As for me, I have given up on trying to get this matter solved. I've spent about 15 hours, this week, trying to solve this problem. It can't be solved. All you'll be able to do is post your frustrations on websites like this one. I think I am going to go buy an old-fashioned Beeper tomorrow, because some scam-artists have beaten me down and AT&T can't do a single thing to solve this problem for me. I am about ready to go out of my mind from the calls I get from this phone number. They also call my 81 year old mom who is on her deathbed in the front room. The guy says "Hellloooo-ooww and then switches me to some recorded sales message.I have called my cell phone company and they can't do a thing about it. I called the police and found out that unless tthe person says he is going to kill me...they can't do anything about it.I registered with the donotcall.gov website and have to wait 31 days to make a complaint.I am amazed that the phone company won't or can't block this number. When I told the phone company that I was going to have to change my phone numberand have to get all my business cards and stationary changed, they decided to take $30 off my phone bill. They weren't even given his cel number. They apparently just found someone near to where I live with my last name, which is an uncommon name, and then called him. Just started receiving these calls from this number (Santander.) Got me as the wrong person w the same name. Never even purchased a car w a loan in my life. It seems dept collectors use any way to find and contact who ever they're looking for. She seemed nice on the phone, apologetic and patient. I'm sure she knows their company can get in serious trouble for harassing the wrong person. Plus it shows how terrible their collection agency is when it comes to doing real business. She told me she will have my number sent to the manager who controls the list of numbers. From there they would have my number remove within 24/48 hrs. I agree with all the responses. My car loan was through Citibank. The first time I had to call customer service I was surprised to get a damn Indiana on the phone. I asked the *(&D(*& if he was in India. He paused and they said yes. I demanded to talk to an American and he said there were none!The only American line I guess was finance. I was enraged because I am so sick of our jobs going to Indian. Next time I called I demanded to talk to the finance people. The agent said there was NO CUSTOMER SERVICE in the states. I was sooooo mad. I would like to have a company with CS in the United States!!Then I get a letter stating that Sanlander will be taking over my car loan. At least I had heard of Citibank. the DNC registry only applies to telemarketers.  If money is owed to a company, they are allowed to contact the debtors.  I know this, as I am always getting calls from my own collection agencies.  I dont LIKE it, but I researched everything to know where I stand with my rights, and thats just how it is.  The government is not going to ban companies from trying to collect on debts.  I try to pay on mine, even if its just a few dollars, and i start getting on track, then WHAM!  medical emergency or WHAM!  car needs costly repairs.  Santander seems to be totally devoid of humans in their workforce though.  After I tried to get a deferment, after paying early every month for 2 years, I was told that I was not eligible for deferment because I was not behind by 3 or 4 months.  I said, fine, I will not be paying until the 27th late day of my payment from now on.  that was a year and a half ago.  They call work and home.  i hang up on all their numbers, of which there are many.  They get their money on my terms.  they deal with me on my terms.  i owe some late fees, but its worth it to not deal with the morons at all.

Goodness people!  If you're going to give out legal advice, please do some research and make sure it's correct before posting!The National Do Not Call list does not apply to bill collectors.  It applies only to solicitation calls.  You cannot do a blanket "opt out" for collection calls.  You can request, in writing, that the collector only correspond with you in writing.  But, the company can require that you submit this request in writing and does not have to comply with verbal requests for no calls.  After all, you did borrow money for the car you purchased.  They have the right to call you to ask for payment until you make a formal request to not be contacted by phone.  This does not fall under the umbrella of "harassment".  If you want to get very technical, in legal terms, "harassment" can only be considered a criminal issue and cannot be the grounds for a civil lawsuit.  I'm guessing you learned that when you attempted to file your lawsuit against them.Additionally, the Fair Debt Collection Practices law that I think you're attempting to cite only applies to 3rd party debt collectors.  Since the company calling you is essentially "the bank", they are 1st party and therefore do not have to follow this law.  Lucky for most debtors, they do follow the law voluntarily because it is good business practice.  So, legally, they can call you every 10 minutes if they want to.  The only way to make it stop is to pay your bills on time or to submit a written request that they cease telephone communication.Finally, the Attorney General's office has no interest in this company of their business practices.  It is actaully the Federal Trade Commission (FTC) that governs this type of activity.  If you want to file a complaint with anyone, I'd suggest them.  But, be aware that they don't respond individually to complaints.  They simply track trends and action only the largest offenders.Just call this company and work out payment arrangements.  It will save everyone involved from a great deal of frustration.

Not true attydallas!  Collectors all use predictive dialers.  I used to work for multiple collection agencies (3rd party) and banks (1st party).  Both use predictive dialers.  They are programmed to pass the call to a collection agent when the call is answered at the other end.  This is why you ALWAYS have to say hello twice.  The first time you're saying "hello" to the computer, the second time the agent hears you.Additionally, 1st party collection departments don't have to be registered and licensed.  These calls are coming from the holder of the note.  They don't have to have any special licensing to call and request that payments are made on time for loans they granted.  That only applies to 3rd party collection agencies who are paid by the holder of the note for collection services.Maybe it's time to go back to law school?

Well, several problems here .. First, debt collecotrs, unlike telemarketers, do NOT use "predictive dialers", since each debt is individualized (e.g. different amounts, sometimes owed to different creditors).  They have to be able to respond if a person picks up.  Hence that is why devices like the Telezapper do not work with creditor calls, unfortunately .. As to the National Do Not Call Registry (and the TX Registry), there are exceptions for calls from creditors, collection agencies, or anyone with whom the listed # has had a previous biz relationshiip.  So putting your name on the list won't stop collection calls.  Third, although Greg Abbott is doing a good job in office, his office will usually seek injunctive relief (i.e. get a court order requiring that a co. stop abusive practices) under the collection and DTPA laws only if enough consumers complain about a particular harrassive collection co. to his office to make it worth his agency's time.   One thing to do if you are in TX is to check with the Att General's office's website to make sure the collection agency is licensed and bonded to do collection work.  Otherwise, they are operating in violation of the law (you'd be surprised how many aren't licensed).  That fact makes it more likely the AG will take action against that company, plus it's good ammo to use against them next time the collection agency calls you!

I beg to differ DHnKC, these are not all sub prime loans.  My husband and I have a loan on our RV which was with GEMB Lending and not sub prime.  We never got calls from them unless we got more than 15 days late, which was rare.  On the other hand, calls from Santander start the day after the actual due date i.e. if the payment is due the 10th, we get calls on the 11th, several a day from varying numbers.  They have been nice enough when we have had them on the phone but the calls do start the day after the payment is due.  By trade I am a mortgage fraud investigator for a large mortgage servicer so I am well versed in FDCPA Rules.  People need to educate themselves and take appropriate action when debt collectors break the rules.

This is not true.  The FDCPA states that collectors can make 1 contact per day, per phone number with you.  A contact is defined as leaving a message or talking to a person.  This is why they don't leave messages in the morning.  If they did, they wouldn't be allowed to call back until the next day.  If you simply answer the phone and tell them when you intend to pay, they will stop calling for the day.  If you keep ignoring them, they will keep calling.

Next time they call cite the Fair Debt Collection Practices Act to them. It states that they can't call you before 8am or after 8pm. It also states that if you notify them in writing that they can't call you at your place of employment, they have to honor it. Make sure you send the letter certified return receipt requested so you have proof they received it. Google Fair Debt Collection Practices Act. It will tell you what is legal and what is not. When you throw that out to a collector, they back off real quick.

Santander is a subsidiary company. At least they usually leave a message. The folks there have been polite when I've spoken with them. But Drive- another story. They call late, not late, paid, not paid. Drives me nuts. Somehow got my teenager's cell # and started calling him. What the heck is that about? I make partial payments and they accept them. I am also 1 month behind because of hardship and they refused a deferment. They will tell you that they don't accept them, but say if your payment is $400 a month and you pay $450, they will accept it. I do mine through my online banking and it's electronically transferred to their accounts so they HAVE to credit me that money.

Just send the partial payment in-watch they will take it. Also, do not defer payments with this company. My ex did and ended up owing over $6,000.00 in interest and penalties. He causes me to be 2 weeks late each month, due to paying my alimony late, but I pay the late fee and and other fees. If they told you they won't take partial payments they are lying to you! They will take whatever money you send them. I pay just slightly over half a monthly payment every 2 weeks and they take it. If you can afford to pay half your payment every 2 weeks you'll make 13 monthly payments in 12 months. This will get you current. I also logged on to my account and changed my work and cell phone numbers to numbers that don't exist. This ended the annoying calls. Lastly, do what I intend to do. Do a total money makeover. Commit to a life with no debt. Pay off this(and all) debt as quick as possible. Then start making a monthly car payment to yourself in an interest bearing account. Save up and buy your next car with cash. Stop dealing with these leeches!!

They did. They call incessantly, and when I explained that I had missed one payment, due to a documented hardship, and was requesting a deferment of that payment, they said I wasn't far enough behind to be eligible. I'm constantly one month behind because I can't afford two payments in one month, and they said they wouldn't take partial payments. Eventually, when I insisted, the rep claimed to apply for a deferment, but if there was an application made, it was declined. I have written to them and asked for help, and they literally ignored my letter.I am about ready to write and tell them I want to do business in writing only--but I'm afraid that will lead them to repossess in retaliation, even though I'm only a month behind (and wouldn't be that if they'd work with me). Any thoughts, anyone?Btw, they have a 214 number which still says it's Drive--but Santander is the new name. You can get calls that say they're from both companies, apparently. But Drive is now Santander. I think they had another name at one, too--something about Road or something like that. They never call our references, but they call us 3-5 times a day, on home and cell numbers.

Can legally only call once every so many days. I never answer when they call because even if you talk to one of their a**les, they'll still call every day. Actually, Santander is also a creditor. We refinanced our auto loan with them a few years ago. We have never had a problem with them at all. When I was laid off this year after an extended medical leave, all we had to do was call them, explain the situation and they extended our payment. When the first extension ran out, we called again asking for an extension. We were advised to wait until a specific date and call back to request the extension. Although we did start getting a few calls from their collections department, we were able to go ahead and extend the payments out once more. Clearly, this is not the best situation, but it is what we have been dealing with. They have been very nice to us and hopefully, things will be better in 2 months when this extension expires. We only have a few more months left on our loan so we want to pay it off as soon as possible.

The law most of you are quoting regarding Debt Collectors, does not apply to Creditors such as Credit cards or Car Loans.  It applies to Debt Collectors only, such as Collection Agencies etc.FTC.gov - fair debt collections practices act    FTC.gov for Credit Card banks is Fair Credit Billing ActHowever the Federal Communications, does have a similar law regarding phone calls at work.  Go to FCC.gov, and download the Complaint form,Also before you do file a complaint with FCC.gov, they will also require you send a Written notice, to Stop Calls, at work, or on certain times / days.  It's always best, to mail letter Certified Mail, so you have a receipt of when you mail and letter, and when it was received and by whom.As to Cease and Desist, again this only applies to Debt Collectors, not Original Creditors, such as on Car loans / Mortgages / Credit Cards, those are different laws entirely.  You can find more information on those at ftc.gov also.  I would personally never send an Original Creditor like this Santander, or a Credit Card bank a Cease and Desist Letter.  Santander will simply repo your car.  Santander is one of the worse Car loan finance companies, for car repos.  And when I talk to Santander, b/c of the reputation on line, I always record all my calls.  During one of these calls, I started to be told a different story, than was given by another employee - I advised that I recorded the call with the other employee, and I'm doing the same with them (my state only requires, 1 party be aware call is being recorded - so check your state's rules first), and Santander hung up on me!!!I am not an Attorney, but I am knowledgable in Consumer Protection Laws, fighting 3 lawsuits against us without an Attorney, and helping others, such as family members and friends only.  I am not giving legal advice, just educating on what I have learned, and what I do myself,  when I get calls when I shouldn't or at inconvenient times.  .

Did you know that by law once you tell them not to call your job, they have to stop or you can report them to the attorney general's office?  google debt collecting and read the law that protects consumer's.  You can also send them a Cease and Desist letter (google it for template) and they are required by law to stop all phone calls. If a bill collector calls you at work, write a certified letter to them stating you are not aloud to receive personal calls. If they call after they have received your letter (don't forget to get the return receipt requested form, which states when they received it and who signed for it and include your account number!!), you then have legal recourse against them. This falls under federal regulations.You must put it in writing.I also have an account that they purchased. I do not answer them. Also, if you go online you can find out what the statues of limitations for each type of loans for your state has. For example, in Maryland, if you owe a debt and for what ever reasons (like hardship,layoff,divorce,etc.), and you have NO contact with them for 3 years, you no longer owe the debt (this is for credit cards). Each type of loans carry different time lines, and each state is different, but there is a complete list for each state and each type of loan-just google it.

Here's some information for you.The vast majority of companies calling you, regardless of the company's size, utilize a computerized system to make their outbound sales and collection (recovery) calls. These systems make more efficient use of tha call center employee's time. The computer makes the outbound call and waits for the line to connect. When you answer the phone, the computer will register the connection and will then transfer the call to a representative who will handle the call. The process works fine, as long as there are enough representatives working to handle the number of calls being answered. If, after a default period of time, the computer cannot connect to an available representative the call will be disconnected. The computer will register the call as a non-connected call as a representative did not speak with you. Your number is then returned to the call queue to be called again when your number cycles to the top again to be called.Their agents are not calling you and listening to you repeatedly say hello.*Rule of thumb. --> If no one responds after you have said hello twice, just hang up and go on with your day., Sadly, they will call again since they have not actually made contact with you. Complaining to a rep once you do get to speak with a person is useless as they just speak to people when the call connects to them. Typically, they are not even able to make outbound calls from their station. Some manager or supervisor is overseeing the call load as directed by some manager who isn't even at the facility.

When you get phone calls from  a phone # you don't know you should be researching them so that you don't get caught  in fraudulant schemes.  I also listened to a new report where people had been scammed and they said to always research the phone # and/or the company they CLAIM to be. A legitimate collection agency CANNOT threaten to send you to jail if you don't pay, that is ILLEGAL.  You can sue them if they continue to harass you.  Send a cease and desist letter.  If they will not give you an address, report the phone number to the FCC and your state's attorney general.  Either way, they can't do anything to you.  They are just trying to collect on a bogus debt or one that is out of the statute of limitations and legally can't come after you.

Coming in on 312.229.0051 - Man claimed his name was Frederick Davis and he was working with a "Law Firm" - did not give the name of the law firm...  Let me know right then and there he was a scammer...  Left a message with a 202.315.4209 call back number. Told me that they were filing against me on Monday so I better call him in the next 24 hours.

Just got a call from a man name eric (no last name) he speaks with a heavy middle eastern accent. He left me a message on my work voicemail i returned the call asked for eric the guy who answered said his phone is busy, but he could help me i asked him why was he calling me about a debt that i dont have and i would like all paperwork faxed to me. He told me that it will be faxed to me right away i asked do you have my fax number he said yes we have a your information. and hung up on me. the voicemail "eric" left me threatend me with law suits and arrest. now im no lawyer or claim to be a genuis but i am no dummy either . these guys are scammers and something needs to be done to shut them and any other's like them down.

Have received several calls on my cell phone always calling for my husband (they have even call him at his place of empoyment) with the 18002199702 number saying to call them back as it is of the most important nature. Women's voice very heavy accent said her name was Sharon Willaims (ya right). She has even called me as well wanting me to return her call. So I deceid to call the so called 800 number from my voip phone. Rang 2 times, voice came on phone said this call may be monitered, then said something about voice mail. That was it. Nothing stating WHO they were or anything. So I informed my husband who informed his emploers that its a scam. If I receive one more call (it usually shows on my id as 0000) I will be contacting my local state police an my attorny gernal. This is not the first time we have gotten these so called  calls.

These calls have been going on for months. They of couse said their names were David Jackson, Joe something...etc....And the reason for their call was a "very serious legal matter"<----and in a very heavy accent. All of the messages ended with "and I hope nothing bad happens to you" ...now that sounds like a threat to me...They knew my bank account information, where I actually had a loan out, my ssn, my phone number(of course) not to mention everyones around me. WAY too much information for me to be comfortable with. anyway, I finally answered the phone one day after they had called my phone, my mothers, my husbands and my work phone, and let them have an ear full. I told them if this was a legit case, then by all means, take me to court....if not stop calling me! They didnt call for about a week and they are back at it again. They wont stop. They will continue to call from various numbers...some have showed up with +82 at the beginning, some have been 0000, then of course there is the 1-800 numbers....be on the look out. dont give them any information....i dont know how these people get this information...but it is quite frightening!

I have just recently begun to receive these messages at work. Only once was I contacted at home by someone claiming to be Jimmy Santana from 716-362-8992. Now I'm just getting several calls at work from someone who will not identify himself but said to be from 'Office of Crime and Investigations' in FL. The messages have been threatening in nature "Don't try to ignore this message. Save yourself from entering into a legal mess'. I could barely understand him from the very thick accent.I have reported both number to the FBI, FTC and my state attorney general. Do NOT give these individuals any money.
